Terms and Conditions for The Basketball Experience

Welcome to The Basketball Experience (the "App"), a mobile application dedicated to providing parents with comprehensive guidance and resources for their child's basketball journey. The App is operated by TakeFlight Basketball ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the App and its services. By accessing or using the App, you agree to be bound by these Terms and all applicable laws and regulations. If you disagree with any part of the Terms, you may not access the App.

1. Acceptance of Terms

By using the App, you confirm that you have read, understood, and agreed to be bound by these Terms. If you are using the App on behalf of an organization or entity, you represent and warrant that you have the authority to bind such organization or entity to these Terms.

2. Privacy Policy

Your privacy is important to us. Our Privacy Policy, which describes how we collect, use, and disclose information from our users, is incorporated into these Terms by reference. By using the App, you agree to our collection, use, and disclosure of your information as set forth in the Privacy Policy.

3. Use of the App

The App provides a platform for sharing and accessing basketball-related advice, guidance, and resources. You agree to use the App only for its intended purposes and in compliance with all applicable laws, rules, and regulations. You may not use the App to:

• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or otherwise objectionable material.
• Violate the rights of others, including copyright, trademark, privacy, or any other proprietary right.
• Transmit viruses, malware, or any other malicious or harmful code.
• Harvest or collect email addresses or other contact information of other users from the App by electronic or other means.

4. Intellectual Property

All content on the App, including but not limited to text, graphics, logos, icons, images, and software, is the property of TakeFlight Basketball or its content suppliers and protected by United States and international copyright laws. You are granted a limited, non-exclusive, non-transferable license to access and use the App and its content for personal, non-commercial purposes as expressly permitted by these Terms and not for any resale or commercial use.

5. User Content

You may be able to submit content, including text, images, and videos, to the App ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the App. However, by submitting User Content, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such content in any form.

6. Modifications to the App and Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We also reserve the right to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall TakeFlight Basketball, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of United States of America, without regard to its conflict of law provisions.
